General terms
These Terms of Service govern your use of AgentYLaw services and the website AgentYLaw.pro. By accessing or using our services you accept these terms. AgentYLaw provides property agent legal consulting to clients in Switzerland and internationally where permitted. Our services are delivered as described on AgentYLaw.pro and through client agreements. These terms explain the rights and responsibilities of users and of AgentYLaw in relation to accounts, content, fees and dispute resolution.
1Eligibility
To use AgentYLaw services you must be legally capable of entering into binding agreements under applicable law and able to comply with these Terms. You represent that the information you submit is accurate and that you have the authority to provide any details on behalf of an organization when applicable.
You must be at least 18 years old to use AgentYLaw services. If you are younger, you may use the site only with involvement and consent of a parent or legal guardian who accepts these Terms on your behalf.
You will use AgentYLaw services only for lawful purposes and in compliance with applicable regulations. You agree not to use the services to infringe rights, evade laws, or facilitate fraudulent activity.
Some services or content may not be available in all countries. Access to AgentYLaw.pro and its services is subject to Swiss law and any local restrictions. It is your responsibility to comply with local laws regarding the use of our services.
2Account management
Certain features of AgentYLaw require creating an account. Account registration requires providing accurate contact and business information and maintaining that information up to date.
You agree to provide truthful and current information. AgentYLaw may suspend or terminate accounts found to contain false, misleading, or outdated data.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify AgentYLaw immediately if you suspect unauthorized access.
Accounts, usernames and access rights are personal and non-transferable unless expressly agreed in writing by AgentYLaw.
If you believe your account has been compromised, notify us immediately by phone at +41766950898 or in writing to Route d'Anniviers 1, 3967 Chalais, Switzerland so we can take appropriate action.
AgentYLaw may suspend or limit access to accounts where necessary to protect the security of the service, comply with legal obligations, or address breaches of these Terms.
3Services provided
AgentYLaw delivers property agent legal consulting including contract review, regulatory guidance, due diligence support, and advisory services tailored to real estate transactions. Services are delivered by qualified consultants and advisors through written reports, meetings or remote consultations as agreed. Content on the site is for informational purposes and should be considered part of a consultative service rather than a substitute for the client’s independent legal counsel when required.
AgentYLaw may modify or discontinue features or services at any time. We will strive to provide notice of material changes to active clients in advance when practicable.
While we aim to maintain high availability, AgentYLaw cannot warrant uninterrupted access. Service interruptions may occur for maintenance, upgrades or due to events beyond our control.
4User responsibilities and rules
When using AgentYLaw services you must comply with the following rules to ensure fair and lawful use:
- Provide accurate and lawful information during registration and in communications.
- Refrain from submitting fraudulent, abusive, or infringing content.
- Respect confidentiality obligations and do not disclose sensitive third-party data without authorization.
- Do not attempt to gain unauthorized access to AgentYLaw systems or data.
- Use services only for permitted real estate and legal advisory purposes.
- Comply with applicable laws and professional standards in your jurisdiction.
- Cooperate with AgentYLaw in contribute of policy violations or security incidents.
5User content
Users may submit documents, messages, and other materials ("User Content") as part of the consulting process. You retain ownership of your User Content subject to the rights you grant below.
You retain ownership of the intellectual property rights in the User Content you submit, unless otherwise agreed in a separate contract.
By submitting User Content to AgentYLaw you grant us a non-exclusive license to use, copy, store and process that content for the purpose of delivering the requested services and for internal record keeping.
You are responsible for the legality, accuracy, and completeness of User Content and for obtaining any third-party consents required to share the content with AgentYLaw.
AgentYLaw may remove User Content that violates these Terms or applicable law. Requests to remove or return content will be handled in accordance with contractual terms and legal obligations.
6Intellectual property
All intellectual property rights in AgentYLaw materials, website content, branding and deliverables provided as part of consulting services remain the property of AgentYLaw or its licensors unless otherwise agreed in writing. Use of AgentYLaw intellectual property without permission is prohibited.
- Do not reproduce or distribute AgentYLaw proprietary content without authorization.
- Do not remove or alter any copyright, activity, or other proprietary notices.
- Do not attempt to reverse engineer or circumvent restrictions in AgentYLaw deliverables.
7Paid services
Certain AgentYLaw services are offered for a fee, including one-off consultations, ongoing advisory retainers and document drafting. Fees and payment terms are specified in proposals, invoices or individual client agreements.
Pricing for services is outlined in proposals, on AgentYLaw.pro or in individual contracts. Prices may vary based on scope, complexity and the level of expertise required.
Payments are due as specified in invoices or engagement letters. Accepted payment methods will be listed on the invoice or as agreed between the parties.
Recurring services or retainers will be billed according to the agreed schedule. Termination of a subscription follows the cancellation terms set out in the relevant agreement.
Refunds for paid services are handled case by case and in accordance with applicable law and the terms of the service agreement. Where a refund is appropriate, it will be processed in a timely manner.
Clients may cancel services as set out in their service agreement. Cancellation may be subject to notice periods or fees if specified in the client contract.
Clients are responsible for any applicable taxes, duties or levies associated with paid services unless otherwise stated. AgentYLaw will itemize taxes on invoices where required.
AgentYLaw may adjust pricing for future services. Existing agreements will be subject to the pricing terms set out in those agreements unless otherwise mutually agreed.
Failure to pay invoices within agreed terms may result in suspension of services, additional charges, or collection actions as permitted by law.
8Professional disclaimer
Information provided by AgentYLaw does not constitute an exhaustive legal opinion tailored to every possible circumstance and should not replace specific legal advice when required. Our consultants provide analysis and recommendations based on the information available at the time of consultation. Clients remain responsible for decisions made based on our advice and for seeking independent legal counsel where necessary.
9Limitation of liability
To the maximum extent permitted by applicable law, AgentYLaw’s liability for direct damages arising from the provision of services is limited to the fees paid for the particular service. AgentYLaw is not liable for indirect, incidental, consequential, or punitive damages. This limitation does not apply where liability cannot be limited under mandatory law.
10Third-party services
AgentYLaw may rely on third-party providers, data sources or subcontractors to deliver aspects of its services. Use of third-party services is subject to those providers' terms and AgentYLaw is not responsible for their conduct or policies beyond what is required to deliver our services.
11Termination
Either party may terminate a service agreement in accordance with the terms of that agreement. AgentYLaw may suspend or terminate access to services for breaches of these Terms, non-payment, or where required by law.
Upon termination, obligations that by their nature survive termination (such as confidentiality, payment obligations, and intellectual property rights) will continue to apply. AgentYLaw will provide reasonable assistance to transition services as agreed.
12Privacy and data protection
AgentYLaw collects and processes personal data as described in our Privacy Policy. By using our services you consent to such processing and to the transfer, storage or handling of data as necessary to provide the services.
13Communications
By using AgentYLaw services you agree to receive communications related to your account and service delivery via email, phone or postal mail. Marketing communications will only be sent with consent where required and will include opt-out options.
14Changes to terms
AgentYLaw may update these Terms from time to time. Significant updates will be posted on AgentYLaw.pro with an updated effective date. Continued use after changes constitutes acceptance of the revised Terms.
15Governing law
These Terms are governed by and construed in accordance with Swiss law. Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the competent courts in the Canton of Valais, Switzerland, unless otherwise agreed in writing.
16Dispute resolution
Where a dispute arises, the parties will first attempt to resolve it informally. If informal resolution is not successful, disputes will be resolved under the governing law provisions above. Alternative dispute resolution methods such as mediation may be considered by mutual agreement.
